TERMS AND CONDITIONS

1. INTRODUCTION

Welcome to the Trinidad and Tobago Electricity Commission’s Customer Web Portal and Native Mobile Application (hereinafter referred to as “the T&TEC App”).

By accessing or using the T&TEC App, you agree to comply with and be bound by these Terms and Conditions (“Terms”) which together with the Commission’s Customer Data Privacy Policy govern the use of the T&TEC App. Please read these Terms carefully. If you do not agree to be bound by these Terms, you will be unable to use the T&TEC App. The Commission reserves the right to amend these Terms at any time. 2. GENERAL TERMS AND CONDITIONS

a) You agree to use the T&TEC App solely for the purpose of accessing customer account services, reporting problems, and receiving T&TEC promotions and notices as permitted by these Terms.

b) You will not incorporate any portion of the T&TEC App’s software into other programs or compile any portion of it in combination with other programs, or otherwise copy (except to exercise rights granted in this section), modify, create derivative works of, distribute, assign any rights to, or license the Commission’s software in whole or in part. All software used in any of the Commission’s Services is the property of the Commission or its software suppliers and its copyright laws.

c) Using the T&TEC App establishes your acceptance of the Terms which shall constitute an Agreement between you (the T&TEC App user) and the Commission.

d) You are responsible for ensuring that you are aware of the Terms and amendments of use and your continued use of the T&TEC App constitutes acceptance.

e) Utilizing the T&TEC App represents that you are at least 18 years of age and are fully able and competent to enter into the Terms in this Agreement;

3. CUSTOMER DATA PRIVACY POLICY

a) Your Privacy is important to the Commission. Please read the Customer Data Privacy Policy which governs the use of information provided to the Commission.

b) The use of the T&TEC App establishes your acceptance of the conditions as set out in the Customer Data Privacy Policy.

3. USER ACCOUNT SERVICES

a) Creating an Account. The Commission grants you a non-exclusive, non-transferrable, limited right to install and use, via the creation of an account, the T&TEC App on your wireless electronic device. Subject to your compliance with these Terms the Commission grants you access to use the T&TEC App.

You can create a T&TEC app account by signing up online. You agree not to use any false, inaccurate or misleading information when signing up for your account. If you create a T&TEC app account on behalf of an entity, such as your business or employer, you represent that you have the legal authority to bind that entity to these Terms. You cannot transfer your T&TEC app account credentials to another user or entity. To protect your account, keep your account details and password confidential. You are responsible for all activity that occurs under your T&TEC app account.

b) Account Use. You must use your T&TEC App account to keep it active. The Commission may suspend your account until you can reclaim ownership. Based on the nature of the compromise, the Commission may be required to disable access to some or all of your content. If you are having trouble accessing your account, please feel free to contact us at app@ttec.co.tt.

c) Access. Access to this T&TEC App shall enable you to use the following services:

– Registration, login and profile management.

– Adding of accounts to your profile as the account holder or non-account holder.

– Accessing customer account services on linked accounts.

– Remit payments on residential, commercial and industrial accounts only.

– Access billing history on linked accounts.

– Signup for E-billing to access PDF bills on linked accounts.

– Access payment history.

– Schedule recurring payments on linked accounts.

– Monitor energy usage on linked accounts.

– Report a problem

– Receive promotional information and alert notifications.

d) All rights not expressly granted to you in these Terms are reserved and retained by the Commission. No part of this T&TEC App may be reproduced, duplicated, copied, sold, resold, visited, or otherwise exploited for any commercial purpose. You may not reverse engineer, decompile or disassemble, tamper with, or bypass any security associated with this T&TEC App, whether in whole or in part.

e) You may not frame or utilize framing techniques to enclose any trademark, logo, or other proprietary information (including images, text, page layout, or form) of the Commission.

f) You may use the T&TEC App only as permitted by these terms and condition and laws of Trinidad and Tobago. The access granted by the Commission shall terminate (i) if you do not comply with these terms and conditions and (ii) at the Commission’s sole discretion.

g) The Commission shall not be responsible for any information which is wrongly entered into the T&TEC App and any loss or damage arising out of same shall be solely for the T&TEC App user.

4. PAYMENT ERRORS AND REFUNDS

a) In the event that an incorrect transaction was processed, a request for its reversal must be made by the cardholder in writing, and submitted with proof of payment and a valid form of identification, via electronic mail, to CControlOfficer@ttec.co.ttfor forwarding to the card issuer.

b) In the event that an incorrect electricity account was submitted and processed for payment, a request for the payment to be applied to the correct account(s) must be made by the cardholder in writing, and submitted with proof of payment and a valid form of identification, via electronic mail, to CControlOfficer@ttec.co.tt.

c) In the event that the credit card holder/Account Holder disputes a transaction with the card issuer, applicable chargeback rights would apply.

d) If any of the above circumstances (a. to c.) results in the reversal of a payment on an electricity account and causes the account to be in arrears, the Commission reserves the right to disconnect the supply and/or apply any late payment charges where applicable.

 e) Under no circumstance will refunds be returned in Cash or Cheque.

5. INTELLECTUAL PROPERTY RIGHTS 

All intellectual property rights in the T&TEC App are owned by, or are under licence to, the Commission by third parties. You shall have no intellectual property rights to the T&TEC App, nor shall you have any rights to copy, adapt, modify or interfere with the system. The T&TEC App may include the Commission’s logos and/or trademark. You acknowledge that you may not copy, use, or mask the Commission’s logo and/or trademarks which appear on the T&TEC App without the prior consent of the Commission.

6. DISCLAIMER

The Commission:

a) does not warrant that the information and data contained on the T&TEC App or sites linked to it are free from computer viruses or malware or that it does not infringe on the intellectual property rights of other any person;

b) does not accept responsibility for any errors in transmission of information using the T&TEC App;

c) reserves the right to modify, or discontinue, the use of, the T&TEC App and content provided on or through it at any time without notice.

d) shall not be liable for any delays, interruptions, errors or failures in the provision of any third-party services not within the control of the Commission including but not limited to force majeure, industrial action, industrial disputes, breakdown or other malfunctions of the Commission’s technical equipment, including software. It should be noted that use of these third-party services may be subject to separate policies, terms of use, and fees of these third-parties.

e) shall not be liable, either in contract or in tort for any direct, incidental, consequential, indirect or punitive damages or any other losses, costs, expenses or damage of any kind claimed to have arisen as a result of using the T&TEC App or as a result of non-availability, non-functioning or malfunctioning of the service or otherwise in connection therewith.

f) reserves the right not to process a transaction if, in the Commission’s sole discretion, it believes same to be fraudulent in nature.
