TERMS AND CONDITIONS
1. INTRODUCTION
a. Welcome to the Trinidad and Tobago Electricity Commission's Online Tender Payment System. The Trinidad and Tobago Electricity Commission (“the Commission”) provides an online system to allow Tenderers to select and purchase tenders via use of a credit card. Tenderer may use the Commission’s software solely for purposes of enabling the ability to view, select and purchase tenders as permitted by these terms and conditions. Tenderer may not incorporate any portion of the System’s software into other programs or compile any portion of it in combination with other programs, or otherwise copy (except to exercise rights granted in this section), modify, create derivative works of, distribute, assign any rights to, or license the Commission’s software in whole or in part. All software used in any of the Commission’s Service is the property of the Commission’s or its software suppliers and is copyright laws.
b. The access and use of Trinidad and Tobago Electricity Commission Online Tender Payment System (https://ttec.co.tt/etendering) (referred herein after as the System) by the Tenderer is governed by the terms and conditions listed hereunder.
c. These terms and conditions, when accepted by the Tenderer, shall constitute an Agreement between the Tenderer and the Commission.
d. The Commission reserves the right to amend these terms and conditions at any time. Tenderers remain at all times responsible for ensuring that they are aware of the amended terms and conditions of use and the continued use of the System by the Tenderer constitutes acceptance.
2. PRIVACY
a. Please review our Customer Data Privacy Policy, which also governs your use of the System, to understand our practices. By subscribing to the Online Tender Payment System, you are agreeing to the conditions as set out in the Customer Data Privacy Policy.
3. LICENSE AND ACCESS
a. Subject to your compliance with these Terms and Conditions, the Commission grants Tenderers access to use the System. Access to this system shall enable the Tenderer to:
(i) view tender information;
(ii) pay for and download tender documentation and information electronically via the internet. Tenders shall be available for download up to and until the closing date and time as advertised.
b. This licence does not include any resale or commercial use of the Commission’s System or its contents; any collection and use of any tender listings, descriptions, or prices; any derivative use of this website or its contents; any downloading, copying, or other use of account information for the benefit of any third party; or any use of data mining, robots, or similar data gathering and extraction tools.
c. All rights not expressly granted to you in these terms and conditions are reserved and retained by the Commission. No part of this System may be reproduced, duplicated, copied, sold, resold, visited, or otherwise exploited for any commercial purpose without express written consent of the Commission. Tenderer may not reverse engineer, decompile or disassemble, tamper with, or bypass any security associated with the Online Tender Payment System, whether in whole or in part.
d. You may not frame or utilize framing techniques to enclose any trademark, logo, or other proprietary information (including images, text, page layout, or form) the Commission without express written consent.
e. You may not use any meta tags or any other "hidden text" utilizing the Commission’s name or trademarks without the express written consent of the Commission.
f. You may use the System only as permitted by law. The licenses granted by the Commission shall terminate if you do not comply with these terms and conditions.
4. REGISTRATION AND USE OF WEBSITE
a. You may need your own Tenderer account to purchase tenders, and you may be required to be logged into the account to purchase tenders. You are responsible for maintaining the confidentiality of your account and password and for restricting access to your account, and you agree to accept responsibility for all activities that occur under your account or password.
b. The Commission sells tenders to Tenderers, who can purchase with a credit card. The Commission reserves the right to refuse service, terminate accounts, and terminate your rights to use the Commission’s System.
5. UPDATES
a. The Commission may offer automatic or manual updates to the Online Tender Payment System Software at any time and without notice.
6. REFUNDS
a. The Commission does not refund tender purchases. For more information about our refund policy, please contact us.
7. TENDER DESCRIPTIONS
a. The Commission attempts to be as accurate as possible. However, where the descriptions may be unclear, please contact us for clarification at tenderqueries@ttec.co.tt
8. PRICING
a. All prices are quoted in Trinidad and Tobago dollars and are non-refundable. . Once the tender is published, its price does not change. Once you enter your credit card information and submit payment, your card will be charged and you will have access to download the tender package as a zipped file and print a receipt.
9. TENDERER'S OBLIGATIONS
a. Tenderers have the responsibility to ensure that the information provided to the Commission, via registering on the System, is accurate, complete, maintained and accessible by you. In the event of a change of this information, you must update same immediately via the website or by contacting the Commission.
b. The Tenderer agrees to grant to the Commission a licence to any information and or documentation provided through the use of the System. The Tenderer acknowledges and agrees that there will be no royalty or other fees payable by the Commission to it, or any third party for this right. The Tenderer shall use the System for lawful and proper purposes only and shall, in any event, comply with all relevant laws and regulations within Trinidad and Tobago.
10. INTELLECTUAL PROPERTY RIGHTS
a. All intellectual property rights in the System are owned by, or are under licence to, the Commission. The Tenderer shall have no intellectual property rights in the System, nor shall it have any rights to copy, adapt, modify or interfere with the website. The website may include the Commission’s logos and/or trade mark. The Tenderer acknowledges that it may not copy, use, or mask the Commission’s logo and/or trademarks which appear on the website without the prior consent of the Commission.
11. DISCLAIMER
The Commission:
a. does not warrant that the information and data contained on the System or sites linked to it are free from infection by computer viruses or that it does not infringe on the intellectual property rights of any person in the world;
b. does not accept responsibility for any errors in transmission or downloading documentation from the System;
c. does not accept responsibility for non-adherence by the Tenderer to the stipulated closing date and times expressed in tender documents or otherwise amended by the Commission;
d. shall not be liable for any delays, interruptions, errors or failures in the provision of any third party services not within the control of the Commission including force majeure, industrial action, industrial disputes, breakdown or other malfunctions of the Tenderers technical equipment, including software. It should be noted that use of these third party services may be subject to separate policies, terms of use, and fees of these third parties.
e. shall not be liable, either in contract or in tort for any direct, incidental, consequential, indirect or punitive damages or any other losses, costs, expenses or damage of any kind claimed to have arisen as a result of using the System or as a result of non-availability, non functioning or malfunctioning of the service or otherwise in connection therewith.
